A Study on Applied Legal English Teaching Mode in the Context of International Legal Talent Cultivation

Abstract:There are many disadvantages in traditional teaching methods of legal English in our country.This paper mainly discusses the teaching mode of legal English courses in universities,and puts forward the teaching methods for legal English innovation,in order to give some reference and inspiration to teachers engaged in legal English teaching and research.

According to the Ninth Five-Year Plan for Legal Education and the 2010 Development Vision,the concept focusing on cultivating high-level,complex,and export-oriented legal talents is proposed by the Ministry of Justice.In the context of globalization,the training of legal English talents has national strategic significance.

Legal English is aimed at students in the second semester of junior high school,who have got a good knowledge of English.The teaching materials used are legal English written by Sha Lijin of China University of Political Science and Law Press,the content of which is mainly to introduce the legal systems of Britain and the United States.We use the criminal trial procedure of the United Stated of America as an example to illustrate the teaching modes of legal education.

The teaching goal of the legal English course is to cultivate senior English talents who have solid basic English skills,good legal understanding,can engage in legal English teaching and practical application work,and adapt to foreign economic and legal affairs.The correct use of various teaching methods is of great significance to the realization of the teaching goals of the legal English curriculum,the completion of the teaching tasks of legal English,and the improvement of the quality of legal English teaching.

The aim of the paper is to explore the effective ways of legal English teaching and solve the problems in legal English teaching,so as to provide a sample for the applied legal English teaching in our school and even in universities across the country.This project is mainly to reflect on the traditional legal English traditional teaching model; The interactive and reversing classroom teaching model and multi-mode information cognitive teaching model are introduced.

1 Preparation before class

Pre-class preparation is a crucial part of the beginning of a class which decide the quality of teaching by design teachers and students.

1.1 Tasks for the teacher in preparation before class

For teachers,preparation before class is not just a matter of reading the textbook.For the criminal justice system in the United States,it is also a matter of teaching methods,consulting relevant materials,studying typical case trial procedures,and teaching methods that need to be applied.

For teaching materials,The teacher should study the key difficulties so that students can learn more smoothly in teaching.Similarly,the collection of relevant materials is also crucial.The explanation of criminal trial procedures in the United States can be used as a case in the Simpson case to collect relevant videos for students to observe.At the same time,the students pre-study task is set up so that students can do the PPT of the relevant system to report and discuss in the class.

1.2 Tasks for students in preparation before class

For students,pre-study before class,including the pronunciation,meaning of new words,understanding of the content of the text,and doing PPT,can properly explain the relevant content,for the reversal of the classroom preparation.

Pre-class preparation is a very important part for students.If there is no pre-study,it may be difficult to follow in the subsequent classroom study.Therefore,in order to encourage students to pre-study,their pre-study status can be recorded in the normal performance results.

2 Classroom instruction

In general,the main purpose of Legal English learning is to cultivate students ability to prepare for reading the original English textbook,understand the legal knowledge of foreign countries and the most important of all,to analyze and deal with foreign cases.

2.1Case teaching model

The use of case teaching method is mainly to understand the language characteristics of legal theory and principles through practical case analysis and discussion.As the textbook is mainly about common law,with famous jurisprudence in various periods of legal development in case law countries.Therefore,for non-English speaking countries,case teaching is undoubtedly the most preferred mode of professional English teaching.

For criminal trial procedures,the school has to use typical cases to implement 16 steps from the occurrence to the execution of judgments in criminal cases in the United States,including:Reported Crime,Pre-arrest Investigation,Arrest,Booking,Post-Arrest Investigation,the Decision to Charge,Filing the Complaint, the First Appearance,Preliminary Hearing,Grand Jury Review,Arraignment on the Information or Indictment,Pretrial Motions,the Trial(Opening Statement,Presentation of Evidence,Closing Arguments,Jury Instruction,Deliberation and Verdict,Post-trial Motion),Appeals and Post-conviction Remedies.In the course of criminal proceedings learning,students are required to master the principles of presumption of innocence,beyond a reasonable doubt,and exclusion of unlawful evidence embodied in the United States Criminal Procedure Law.

2.2 Interactive teaching model

All-English interactive teaching method refers to the use of speech and body simulations in the course of specific teaching.Legal English is aimed at junior students who have a certain English foundation.Therefore,it is possible to try to teach in English as much as possible.This requires students to master the new words and main contents of this lesson before class.The situation creates a language environment that is as realistic as possible for students to understand legal issues in an English language.Promote conversational and applied learning methods to create an interactive classroom atmosphere so that students can understand,which can be combined with the Simpson trial photos to interact with students.

2.3 Flipped Class Model

It is different from the traditional classroom teaching model.Under the flip classroom teaching model,students complete knowledge learning at home,and the classroom becomes a place for interaction between teachers and students and between students and students,including answering questions and solving puzzles,the use of knowledge,so as to achieve better educational results.The main feature of our flipped class is to allow students to pre-study before class and do PPT explanation video,plus the teachers comments,including the advantages and disadvantages of the video screen knowledge explanation,and how to improve it.The teachers more responsibility is to understand students problems and guide students to use knowledge.

2.4 Multimedia-assisted Teaching Model

The emergence of network technology has realized global resource sharing,and opened up a new network education era for education.Multimedia network technology should be made full use of to improve the original teaching model,so as to develop the teaching of legal English toward individualized learning and fully mobilize the enthusiasm of both teachers and students.For the American criminal procedure,we can explain the various steps of the U.S.criminal trial in conjunction with the video fragments of the Simpson case,which is relatively intuitive and students can understand it very easily.

3 Summary after class

After class,it is very important to sum up afterwards.For the teacher,we should carefully consider the advantages and disadvantages of the teaching method of this unit,classroom effect and students acceptance ability.Advocating discussion and application-oriented learning methods,and creating a classroom atmosphere of teacher-student interaction,interaction between students,the guidance of the“student-oriented”educational ideology breaks the traditional teaching model,takes students as the center,and interprets legal issues in an all-English manner.In this way the students can understand the teaching content and respond positively to complete the teaching content and achieve the teaching purpose.

To explore the effective ways and solve the problems in legal English teaching,we should put forward innovative ideas of teaching models to meet the needs of national strategies.The training needs to conform to the three principles of“diversification”,“specialization” and“professionalization”,and train complex talents who can handle first-line law enforcement and legal services that deal with foreign-related business.We hope it will provide a sample for the applied legal English teaching in our school and even in universities across the country.
