Chen Guoquan, Yuan Guinan

(School of Public Affairs, Zhejiang University, Hangzhou 310058)

(26)

Abstract:Modern political civilization is the great achievement of human political activities.Democracy, liberty, the rule of law, integrity are the basic values of modern political civilization, and separation of powers is the institutional basis for realizing the values of democracy, liberty, the rule of law, and integrity. The economy determines the superstructure.Due to the significant difference in economic foundation, different government, market and social relations have been created, so the western power system of separation of powers cannot guide Chinese theory and practice. The theory of functional separation of power starts from China’s reality, fully considers the economic system of public ownership and the integral relationship between Chinese Communist Party and the government, then puts forward the framework of mutual restriction and coordination of decision-making power, executive power and supervision power, showing the proper internal logic, power structure and operating mechanism. It is committed to realizing the unity of democracy, liberty, rule of law, integrity and other values when the public power being used. The theory is both local in theory and feasible in practice, and has great enlightenment significance for the construction of China’s modern political civilization.

On the Division of Real Right in Immovable Property under the Interface of Public Law and Private Law

Shi Yifeng

(Guanghua Law School, Zhejiang University, Hangzhou 310008)

(44)

Abstract:The division of real right in immovable property is a complicated legal issue involving multiple perspectives, such as public law and private law.The contract concerning the division of real right in immovable property, although generally a private behavior under the parties’ autonomy, will be affected by the approval behavior in public law because of the partitioning of land use right. In the aspect of public law,the approval authorities, led by the land and resources authorities, shall formulate an approval document after soliciting the opinions of other authorities including urban and rural planning, housing and urban-rural development, so as to simplify the approval procedures. The approval standards shall refer to the relevant provisions of Regulations on Real Property Unit Formation and Identifier Coding, Regulations for Cadastral Survey, and other regulations.Additionally, the approval standards shall specify the requirements for division and transfer in consideration of the necessity and feasibility.Meanwhile, the approval is a type of administrative approval behavior with externality.Given this nature, the subjects of right should be entitled to initiate an administrative lawsuit to obtain relief. In the aspect of private law, the approval does not affect the validity of contract concerning division and transferof real right in immovable property. To the contract without approval or with impossibility of performance, its validity would not be affected. However, the contract itself would fall into the impediment to performance. In this case, the parties concerned could properly allocate risks and liabilities through default liabilities or contract rescission.

Key words:division of real right in immovable property; approval behavior; validity of contract;cross-legal perspective; complexity law

Property Right in NFT Digital Asset:on the Perspective of Bundle of Right

Ruan Shenyu

(Law School, Renmin University of China, Beijing 100872)

(55)

Abstract:The traditional concept of ownership and its implied “object paradigm” can hardly explain the legal status of the holders of the digital assets mapped by the NFT.Under the paradigm of bundle of rights, the property right is not the object itself, but the collection of the subject’s right to use the object. The advantage of the bundle of rights paradigm is that it has a strong descriptive function on the generation process of new property rights. However, it relies on external standards such as economic analysis to determine the initial distribution of new property rights, so it lacks normative function. As a value-neutral analytical tool, the bundle of rights paradigm can be combined with the methodology of value law to transform the initial distribution of new property rights into the legal interpretation of the boundary of legal property rights. The essence of the new property right of the holder to the digital asset mapped by the NFT is “nominal ownership”, and its directional duty is that others shall not tamper with the nominal ownership without consent. The nominal ownership of digital images of objects such as cultural relics should not be initially allocated to the owner of the object, but should be kept in the public domain.

Key words:new property right; NFT; bundle of rights; internal system

Image:An Observation of Gazing Field

Wang Haiming

(Institute of Law, Zhejiang Academy of Social Sciences, Hangzhou 310007)

(64)

Abstract:The image in the vision of image interpretation, as the reality of the life-world, is a reality of a specific social space. If it is separated from this space, image interpretation is often prone to fall into incompletion and distortion. The gazing field of an image is realistic, cognitive and constructive, including the gaze of the painter and the gaze of the viewer.By gazing field, the image connects the complex relationship between the painter’s external life-world and his spiritual space, connects the painter and the viewer, and carries the overlap of the painter’s spiritual space and the viewer’s spiritual space.Putting images in the social space where they are located for approaching, observing and thinking is the regression of image observation and image interpretation methods, and also a very close path and method to understand the reality, richness and development of images.

Key words:image; life-world; gazing field; painter’s gazing; viewer’s gazing

Image:A Historic Adjustment from Spatiality to Temporality

Nan Yuanhan

(School of Art, Hangzhou Normal University, Hangzhou 311121)

(74)

Abstract:How does the image express the thingness? From a macro perspective, the representation image paradigm as a whole presents the adjustment from spatiality to temporality.During the Renaissance, the image took the spatial nature as the basic structure of the thingness presentation, the artist’s deeply planted concept regarded the nature of the object as the truth of the life world, and the image emphasized the eternal and universal spatiality of the life world. This universal expression shapes and strengthens the manifestation of the spatiality of the image. In the first half of the 19th century, images paid more and more attention to the expression of temporality. On the one hand, based on the development of spatial vision theory itself, the individuality and temporality of subject visual perception is gradually highlighted; on the other hand, in the process of creating images, subjective factors continue to highlight, the visual model of subject-object opposition is gradually broken. With the innovative use of color, the temporality of the life world has been strengthened and reconstructed.

How to Recognize the Difference between Marxist Political Philosophy and Western Normative Political Philosophy?

Li Dianlai

(School of Philosophy, Wuhan University, Wuhan 430072)

(94)

Abstract:Although Marx criticized the normative discourse of rights, equality and justice in many cases, his theory contains rich and profound political philosophical thoughts that support normative judgment. However, compared with Hobbes, Locke, Hume, Rousseau and Kant, Marx grasped political philosophy in a specific context, in a specific way and from a specific level. There are significant differences between Marxist political philosophy and western normative political philosophy, no matter in terms of the way of argumentation or level of thought.Only by fully recognizing these differences rather than taking the western normative political philosophy as the absolute standard, can we construct the “Marxist political philosophy” in line with Marx’s theoretical requirement and pursuit, and can we make a more comprehensive evaluation of the western normative political philosophy.

Marx’s Classical Understanding of “State” and the Political Philosophy Foundation of Modern State TheoryQi Guang

(School of Marxism, China University of Mining and Technology, Xuzhou 221116)

(103)

Abstract:In political philosophy, the understanding of Marx’s theory of state is inseparable from its comprehensive understanding of the classical theory of state. After the Enlightenment, the western country theory experienced the deduction of the centralism country theory, the anti-centralism country theory and the metaphysics country theory, and formed a relatively mature interpretative construction of the modern country. When criticizing the modern country, Marx, as the “ancients”, projected the vision and thinking of the classical theory of state into his speculation, and generated a new interpretation path of the theory of state based on the anti-centralism theory of state but beyond its negative significance. He combined the classical theory of state with the anti-centralism theory of state, and subverted the basic category and underlying logic of the centralism theory of state in the political and economic criticism. It also transcends the abstraction of the metaphysical state theory.Through the continuous promotion of the four periods, including the doctoral thesis, the Rhine, Paris and London, Marx actively made up and enriched the classical theory of state, especially the Aristotelian interpretation of state, and gradually outlined the boundary and outline of Marx’s theory of state in the sense of epistemology.Today, Marx’s theory of state through classical understanding still provides the key political and philosophical foundation for modern state theory, especially in the research and debate of the relationship between the state and class, the problems of modern state, the transformation of state form and other issues, Marx’s insight has always played an indispensable role, and is the important context and construction basis of contemporary Chinese Marxist state theory.

Key words:Marx; classical theory of state; enlightenment centralism; anti-centralism; metaphysical state theory

Critical Theory and Anti-colonialism:An Analysis Based on Critique of Externalization

(114)

Abstract:In the history of the development of Frankfurt School’s critical theory, the issue of colonialism has been neglected for a long time.Theorists represented by Allen believe that this neglect is an inevitable product of the construction logic of contemporary critical theory. However, Allen’s account of contemporary critical theory is not a complete picture of the development of critical theory today.Examining Lessenich’s social theory of externalization shows that critical theory can be integrated into new perspectives in the study of colonialism. The reason why externalized social theory can represent a new development direction of contemporary critical theory is that it is a further expansion and analysis of the concept of “social practice”, and the emphasis on the concept of social practice is a new feature of the development of contemporary critical theory.Starting from the concept of social practice, externalized social phenomena can be grasped from three levels:structure, process, and practice, which correspond to power, exploitation, and habitus respectively. The analysis at the practical level is the decisive dimension of externalized society. The formation of externalized social habitus also depends on the support of the individual psychological level.Externalized practice is not only the social practice of the externalized society, but also the psychological practice. It operates through the mechanism of outsourcing, separation and diversion. The contribution of externalized society theory to anti-colonial narrative is that it can effectively supplement the dimension of continuous growth neglected by neo-Marxist world system theory, and can more accurately grasp the object of colonialism’s criticism, and can better criticize the ideology in the capitalist society.

Key words:critical theory; Lessenich; externalization; colonialism

The Aesthetic Problems of Woolf’s Elitist Critical View

Xu Dai, Zhang Yuru

(College of Media and International Culture, Zhejiang University, Hangzhou 310058)

(130)

Abstract:While using stream-of-consciousness technique to become the representative figure of modern literature, Woolf established her important position in contemporary novel poetics with the elitist literary critical view of “leading to purity” and “embracing elegance”.For a long time, compared with the high attention paid to her achievements in literary creation, the academic circle has basically remained empty praise on how to evaluate her achievements in literary criticism, lacking serious and in-depth discussion and accurate grasp.Ignoring the difference between the two concepts of “social elite” as a cultural identity and“elitism” as a class consciousness makes us turn a blind eye to the aesthetic problems existing in Woolf’s critical view of elitism.Facts show that the quality of “transcending mediocrity” contained in elite culture is valuable, but the elitism represented by the spirit of British culture is fundamentally the ideology of “Westernism”under the guise of spreading cultural hegemony. This makes it necessary for us to carefully examine the elitist stance of Woolf’s critical view.

Key words:Virginia Woolf; literary criticism; purity; elitism

Garden and Scenery:The Garden Turn of Landscape Aesthetics and the Formation of “Poetic Scenery” in Tang Dynasty

Wang Shuyan

(School of Humanities and Communication, Zhejiang Gongshang University, Hangzhou 310018)

(140)

Abstract:As for the reasons for the formation of the theory of Tang poetry, the academic circle has neglected the important phenomenon of the gradual transition from landscape aesthetics to garden aesthetics. In fact, it is the garden turn of landscape aesthetics that promotes the formation and maturity of the aesthetic meaning of “Jing”,and then into poetry, directly affect the formation of poetic artistic conception, as well as the formation of poetic conception theory. It is no coincidence that the creation of garden aesthetics and the aesthetic meaning of landscape and the formation of the theory of poetic landscape rose at the same time in the mid Tang Dynasty, but the inevitable result of their long-term mutual influence, infiltration and staggered development. The emergence of “Jing”in the Tang Dynasty and the formation of the theory of poetic conception in the Tang Dynasty, in addition to the metaphysics, Buddhism and the law of the development of poetic art itself, the garden turn of landscape aesthetics is an important factor that cannot be ignored. At the same time, the theory of “poetic conception” has deepened the garden aesthetics in reverse, and has affected the construction of poetic sentiment of gardens in later generations, and even further involves other art fields, enriching and expanding the research horizon of Chinese classical art and Chinese classical aesthetics.

Key words:garden aesthetics; garden realm; theory of poetic conception; tang poetry

Abstract:Nearly a thousand pieces of Zen Monks’ calligraphic works during the era of Song Dynasty and Yuan Dynasty are stored in Japan, which are the products of the dialogue between Chinese and Japanese Zen monks. After spreading eastward to Japan, these calligraphic works were treasured in temples and since the 16th century they became a medium of dialogue between Japanese tea specialists and Zen monks and an integrated part of matcha culture or powdered tea culture. After Meiji reform, they became the collectibles of“sukisha”(tea ceremony lovers). As the establishment of various cultural institutions in the 20th century, these calligraphic works have become the objects of appreciation and research. This process vividly demonstrates that the calligraphic works of Song Dynasty and Yuan Dynasty stored in Japan are not only tools of communication but also the products of cultural assimilation, and they are even a symbol of the progress of social civilization during a specific period of historic evolution. To explore the profound essence and laws hidden in the cultural exchange and assimilation represented by Zen monks’ calligraphic works of Song Dynasty and Yuan Dynasty is helpful for us to learn and interpret the cultural exchange between China and Japan and the formation of the east Asian culture circle, and we can even get an effective approach to the history of human civilization.
